Terms of Service

These Terms of Service (the "Terms") govern your access to and use of the website at LostFunds.com and any related communications and services provided by LostFunds, LLC ("LostFunds," "we," "us," or "our"). By using our website, responding to our outreach, or engaging our services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use our services.

1. Who we are

LostFunds, LLC is a private asset-recovery company with its principal place of business at 111 NE 1st Street, Suite 8583, Miami, Florida 33132. We help people recover unclaimed money and surplus funds that are owed to them — for example, surplus proceeds from a tax-deed or foreclosure sale, and unclaimed property held by a state (such as the Florida Department of Financial Services).

LostFunds is not a government agency and is not affiliated with, endorsed by, or connected to the State of Florida or any other government body. LostFunds is also not a law firm and does not provide legal advice. Where a claim requires a licensed representative to file on your behalf, that work is performed by independently licensed attorneys we engage and pay (see Section 4).

2. You can claim these funds yourself for free

You have the right to pursue any unclaimed funds or surplus owed to you directly with the holding government agency at no cost, without using LostFundsor any representative. Florida's unclaimed property can be searched and claimed for free at the State's official website. Engaging LostFunds is entirely optional; you are choosing to pay for our assistance and the convenience, work, and cost we take on.

3. Our service and the contingency fee

If you choose to work with us, we identify the funds, locate and verify ownership, prepare and file the claim (through our licensed attorneys where required), and pursue the recovery through to payment. We work on a contingency basis: our fee is a percentage of the amount actually recovered, and if nothing is recovered, you owe nothing — no fee and no costs.

For Florida unclaimed property, our fee does not exceed the maximum permitted by Florida law (Fla. Stat. § 717.135, currently up to 30% of the amount recovered). The exact fee and all material terms are disclosed in, and governed by, the separate written Recovery Agreement you sign before we act (Section 4). We front and bear all filing and legal costs; you pay nothing out of pocket.

4. The Recovery Agreement governs the engagement

These Terms govern your use of our website and our outreach to you. They do not, by themselves, authorize LostFunds to file or recover anything. Any actual recovery engagement is governed by a separate Recovery Agreement and Limited Power of Attorneythat you review and sign, which sets out the specific property, the fee, the licensed claimant's representative, and your right to cancel. If anything in these Terms conflicts with a signed Recovery Agreement, the Recovery Agreement controls for that matter.

5. No guarantee of recovery

We do not guarantee that any claim will be approved or that any specific amount will be recovered. Amounts referenced in our outreach are estimates based on public records and may differ from what a government agency ultimately determines and pays. Eligibility, documentation requirements, and timelines are set by the holding agency, not by LostFunds.

6. Information you provide

To pursue a claim we may need information and documents from you, including proof of identity and, where the holding agency requires it, your Social Security number. You agree to provide accurate, complete information, and you represent that you are the lawful owner of, or are legally entitled to, the funds being claimed. You must be at least 18 years old to use our services. Handling of your information is described in our Privacy Policy.

7. Communications consent

By providing your contact information or responding to our outreach, you consent to receive communications from us by email, mail, phone, and (where you provide a mobile number) text message, about funds that may be owed to you. You can opt out at any time by using the unsubscribe link in our emails or by emailing support@lostfunds.ai. Message and data rates may apply. You also consent to sign documents electronically under the federal ESIGN Act and Florida's Uniform Electronic Transaction Act.

8. Acceptable use

You agree not to misuse the website, attempt to access it in an unauthorized way, interfere with its operation, or provide false information. All content on the website is owned by LostFunds or its licensors and may not be copied or used without permission.

9. Disclaimers

The website and our services are provided "as is" without warranties of any kind, express or implied, to the fullest extent permitted by law. LostFunds does not provide legal, tax, or financial advice. Nothing on the website creates an attorney-client relationship; any such relationship arises only with the licensed attorney under a separate engagement.

10. Limitation of liability

To the maximum extent permitted by law, LostFunds and its members, officers, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost recovery, arising from your use of the website or our services. Our total liability for any claim relating to a recovery will not exceed the fees we actually received in connection with that recovery.

11. Indemnification

You agree to indemnify and hold LostFunds harmless from any claims or losses arising from information you provide that is inaccurate, or from your breach of these Terms or of any representation that you are entitled to the funds claimed.

12. Governing law and disputes

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Any dispute arising out of these Terms or our services will be resolved in the state or federal courts located in Miami-Dade County, Florida, and you consent to that venue.

13. Changes to these Terms

We may update these Terms from time to time. The "Effective date" above reflects the latest version, and continued use of the website after a change constitutes acceptance of the updated Terms.
